Terms and Conditions

James Layout Services, LLC

  • Fees & Validity
    Fees quoted remain valid for thirty (30) days from the date of the estimate. After thirty days, James Layout Services, LLC reserves the right to revise fees and resubmit the proposal.

  • Payment
    All invoices are payable upon receipt. Final documents will not be recorded or released until payment has been made in full. James Layout Services, LLC reserves the right to issue monthly invoices for services performed throughout the project.

  • Retainer
    Certain project types require a retainer prior to commencement of work as outlined in the estimate. Failure to comply with payment terms may result in the filing of a Mechanic's Lien against the property in accordance with applicable state law.

  • Cancellation
    Cancellation must be submitted in writing via email or U.S. Certified Mail. The client remains responsible for payment of all work performed from the date of authorization through the date written cancellation is received.

  • Late Payment
    James Layout Services, LLC reserves the right to suspend work on the project if any invoice becomes past due. A service charge of 2% per month may be applied to balances more than thirty (30) days delinquent. Accounts referred for collection may be assessed an additional charge of up to 24%. Accounts delinquent more than thirty (30) days may result in suspension or termination of project progress. Upon payment of outstanding balances, work may resume; however, original schedules and deadlines cannot be guaranteed.

  • Ownership of Documents
    All documents, including but not limited to drawings, plans, letters, notes, calculations, renderings, reports, models, specifications, and exhibits produced by James Layout Services, LLC are instruments of service and shall remain the property of James Layout Services, LLC. These documents may only be used for the specific purpose for which they were originally produced. Any other use is strictly prohibited. If work products are prepared in or converted to electronic or digital format, the stamped seal and signature must be an original only. Computer-generated copies, photocopies, or facsimiles of the original stamped seal and signature are not valid. Unauthorized reuse is undertaken entirely at the risk of the unauthorized user. The client agrees to defend, indemnify, and hold harmless James Layout Services, LLC from any and all claims, injuries, damages, losses, expenses, and attorney fees arising out of unauthorized use or modification of this data.

  • Schedule
    Estimated turnaround times are subject to weather and site conditions. James Layout Services, LLC cannot guarantee original schedules if work is suspended due to non-payment or other circumstances beyond our control.

  • Easements
    Any easements to be shown on the survey must be provided to the surveyor by the client. The abstractor's Title Commitment, Section B-II (Exceptions) will list all recorded easements affecting the property. If a copy of the exceptions section is provided, any easements deemed plottable will be shown on the survey plat.

  • Scope Limitations
    The survey is based on record information available at the time of the survey. James Layout Services, LLC is not responsible for unrecorded encumbrances, liens, or title defects that are not discoverable through standard research methods.

  • Accuracy & Standards
    All surveys are performed in accordance with the Arkansas Minimum Standards of Practice for Property Boundary Surveys and Plats. Results are accurate to the standards required by state law.

  • Third Party Fees
    The client is responsible for any fees charged by third parties including but not limited to county recording fees, city/county review fees, and title company fees.

  • Site Access
    The client is responsible for ensuring James Layout Services, LLC has unobstructed access to the property. Delays caused by lack of access may affect the project schedule and could result in additional fees.

  • Force Majeure
    James Layout Services, LLC shall not be liable for delays caused by circumstances beyond our control including but not limited to weather, natural disasters, or government actions.

  • Liability Limitation
    The liability of James Layout Services, LLC shall be limited to the total fee paid for the specific survey in question.

  • Dispute Resolution
    Any disputes arising from this agreement shall be resolved through binding arbitration in Washington County, Arkansas in accordance with applicable state law.

  • Governing Law
    This agreement shall be governed by the laws of the State of Arkansas.
